West Design can register domain names on behalf of our customers. If West Design registers a domain name, the customer will be the legal owner of the domain name. We make no representation that the domain name you wish to register is capable of being registered by or for you. You must therefore not assume registration of your requested domain name until we have notified you by email that the requested domain name has been registered.
Domain names registered by West Design are usually registered for a period of 2 years. The customer may be sent a reminder 30 days before the domain name expires with full details on how to renew their domain name.
If the domain name is registered by a company other than West Design, the customer has full responsibility in making sure that the domain name is renewed when due and no reminder will be issued by West Design before the domain name expires. If a fee is required to release the domain name from its current host, West Design will invoice the customer for this amount.
All websites created by West Design are hosted at a charge of between £10.00 to £20.00 per month, this may include 2-3 changes per month depending on tariff and web space. Customers are required to pay a full years hosting fee at the beginning of their hosting period. The customer may be sent a reminder 7 days before the web hosting expires with full details on how to renew their web hosting service.
West Design reserve the right to suspend any website where the web hosting has expired and the customer has not paid the renewal fee by the agreed date. Renewal of West Design Web Hosting is payable annually. The date of renewal will be 1 year from the date the website was published to the Internet.
The standard web hosting service offered by West Design has a maximum of 750mb of website space unless otherwise stated in your initial quotation. Should your website require more than 750mb of space we will advise of other web hosting options.
All quotations issued by West Design are valid for a period of 14 days after which West Design reserves the right to re-quote.
Payments for Website Design Services
West Design accepts payments by BACS, Standing order, debit / credit or cheque. Domain name and web hosting renewals must be paid for in advance.
West Design is not responsible for writing text content for websites. If the customer cannot write suitable copy for the website then West Design would recommend that the customer employs the services of a professional copywriter with experience of writing for websites.
Website Content Ownership
The customer will own the copyright to the website contents including text copy, photos, graphics and logo after the website has been paid for in full. intellectual property belongs to West Design.
West Design can design a logo for the customer for use on their website, at an additional cost to the customer. Upon project completion and balance paid in full, the customer can request a digital copy of the logo for offline use- for example the customer may want to use the logo on their letterheads, business cards, brochures etc.
If the customer is not satisfied with the initial design concepts provided by West Design, the customer may request a refund within the initial 24 hours, by completing the contact form on contact us page on www.westdesign.org.uk website. Upon receipt of the completed form, West Design will review the customer’s request. West Design will not agree to refunds if the customer has already verbally approved the acceptance of any designs.
All web design contract/s must be completed and balance paid within a period of no longer than 2 weeks from date of deposit.
Any contract/s not completed within this timescale due to client delay may incur additional charges of £10.00 per day, as per terms of trade by West Design a subsidiary of WBV. Deposits are non-refundable.
Any customer who wishes to make a complaint concerning any of the services provided by West Design should initially raise the matter with a member of staff with whom they normally deal or alternatively contact West Design with full details of the complaint by e-mail to email@example.com
West Design expressly reserves the right to terminate or suspend the customer's account without prior notice should the customer fail to comply with these Terms and Conditions or fail to pay an invoice in full as in the stated payment terms as displayed on the invoice or should West Design deem such action necessary to protect West Design and in such circumstances West Design will confirm such termination or suspension by subsequent notice. If the customer wishes to cancel the contract, customer must inform West Design 30 days before date of cancellation in order for DNS settings to be change over and domain name lifted successfully. All contracts are for a minimum of 12 months. If the customer wishes to move their domain name away from West Design, they must advise West Design within a minimum of 30 days before the end of the 12 month period. If the customer wishes to leave West Design before the end of the 12 month contract, they must pay the hosting payments for the remainder of the contract.
Exclusion of liability
To the maximum extent permitted by law West Design excludes liability for any loss, claim, damages or any special, consequential, exemplary or punitive damages (whether directly or indirectly incurred) of any kind arising out of or in connection with any visitor's or user's access to, or use of our website, any material within our website, our services, whether based in contract, tort or whether negligent or otherwise, even if West Design has been advised of the possibility of such damage.
Third Party Services
Goods and services of third parties may be advertised and/or made available on or through this web site. Representations made regarding products and services provided by third parties are governed by the policies and representations made by these third parties. We shall not be liable for or responsible in any manner for any of your dealings or interaction with third parties.
